1. The Platform

Evolve Fits is a neutral marketplace that connects clients seeking professional fitness services ("Clients") with independent, vetted fitness professionals ("Trainers"). We are not the employer of any Trainer, nor are we a direct provider of fitness services. Our role is to facilitate these connections through our Platform.

2. User Accounts

To access certain features of the Platform, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate. You are responsible for safeguarding your password and for any activities or actions under your account.

3. Bookings, Payments, and Cancellations

• Bookings: Clients can book sessions with Trainers through the Platform based on the availability shown. A booking is confirmed once payment is successfully processed.
• Payments: All payments for sessions are processed through our secure third-party payment provider. You agree to pay all fees and applicable taxes for bookings you make.
• Cancellations & Refunds: Our cancellation policy is as follows: A full refund is provided if a session is cancelled more than 24 hours before the scheduled start time. Cancellations made within 24 hours of the session start time are non-refundable. Trainers and Evolve Fits reserve the right to cancel a session under extenuating circumstances, in which case a full refund will be issued.

4. Responsibilities

• Clients: You agree to provide a safe and appropriate environment for any in-person training sessions and to communicate any health conditions or physical limitations to your Trainer prior to a session. You acknowledge that fitness training involves inherent risks of injury.
• Trainers: Trainers are independent contractors and are solely responsible for the services they provide. They agree to maintain their certifications, provide a high standard of service, and adhere to the professional code of conduct outlined by Evolve Fits.

5. Limitation of Liability

To the fullest extent permitted by law, [Your Company Name] shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Platform; (b) any conduct or content of any third party on the Platform, including without limitation, any defamatory, offensive, or illegal conduct of other users or third parties; (c) any injury or damages sustained as a result of a fitness session.

6. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United Arab Emirates, as applicable in the Emirate of Dubai, without regard to its conflict of law provisions.

7. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.
